General terms and conditions
When you, as a customer, order or purchase a product via the website or in the workshop of Teun's Timber, you must agree to these General Terms and Conditions of Teun's Timber.
Article 1. Definitions
In these terms and conditions the following terms shall have the following meanings:
General Terms and Conditions: these General Terms and Conditions that apply between Teun's Timber and the Customer.
Teun's Timber: In these General Terms and Conditions and elsewhere on its website and in the workshop, 'Teun's Timber' means the general partnership Teun's Timber, registered in the Trade Register of the Chamber of Commerce in Enschede under number 80547494 with VAT number NL101517452B02.
The head office of Teun's Timber is located at Looweg 27, 7135 JH in Harreveld, telephone number: 06-15 43 66 48, email address: teun@teunstimber.nl, available from Monday to Friday from 9:00 AM to 5:00 PM and on Saturdays from 10:00 AM to 4:00 PM.
Customer: a (legal) person who purchases a product via the Teun's Timber website or workshop.
Purchase Agreement: the purchase agreement concluded between Teun's Timber and the customer when purchasing a product.
Product(s): all products offered by Teun's Timber on the website and in the workshop.
Working day(s): Monday to Friday, except for the following official holidays in the Netherlands: New Year's Day, Easter Monday, King's Day, Ascension Day, Whit Monday, Christmas Day and Boxing Day.
Reflection period: the period within which the customer can make use of his right of withdrawal;
Article 2. Applicability
1. These General Terms and Conditions apply to every product and all purchase agreements concluded between the customer and Teun's Timber.
2. When placing an order for a product, every customer acknowledges that these General Terms and Conditions apply to it and thereby accepts the applicability of these General Terms and Conditions.
3. These General Terms and Conditions are available to the customer on the website and will be sent free of charge upon request by the customer.
4. These General Terms and Conditions and the regulations and rules applicable thereunder can be changed unilaterally by Teun's Timber. Changes will only come into effect after the changes have been announced on the website. If a customer places an order for a product after the announcement described in the previous sentence, he thereby accepts the applicability of the changed General Terms and Conditions.
Article 3. Customer account
1. The customer is at all times responsible for keeping his login details secret and for the use thereof (such as the user name and password) and for the accuracy of the data in his own account.
2. The customer declares to act in accordance with these General Terms and Conditions and all applicable laws and regulations.
3. The customer must be reachable by e-mail and telephone, so that Teun's Timber can contact the customer about the goods ordered and to be delivered.
4. Only legal entities, or persons aged 18 or over, may place orders via the Website.
Article 4. The Offer
1. If an offer of a product has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
2. The offer contains a complete and accurate description of the product offered. The description is sufficiently detailed to enable the customer to properly assess the offer. If Teun's Timber uses images, these are a true representation of the product offered. Obvious mistakes or obvious errors in the offer of the product do not bind Teun's Timber.
3. Each product contains such information that it is clear to the customer what rights and obligations are associated with the purchase of the product.
4. Price and model changes and text errors reserved.
Article 5. Purchase agreement
1. After acceptance of the order and compliance with the conditions set, a purchase agreement will be concluded between the customer and Teun's Timber.
2. Teun's Timber confirms the purchase agreement to the customer.
3. Teun's Timber ensures a secure online environment and will take appropriate security measures for electronic payments.
4. If Teun's Timber sees reason to do so, it is at all times entitled not to process certain orders for products from customers or to attach (additional) conditions to them.
5. Teun's Timber may - within legal frameworks - inquire whether the customer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance purchase agreement. If Teun's Timber has good reasons on the basis of this investigation not to enter into the purchase agreement, it is entitled to refuse an order or request with reasons or to attach special conditions to the execution.
6. Teun's Timber will provide the following information to the customer at the latest upon delivery of the product:
a. the visiting address of the Teun's Timber branch where the customer can go with complaints;
b. the conditions under which and the manner in which the customer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
c. the information about guarantees and existing after-sales service;
d. the price including all taxes of the product; where applicable, the costs of delivery; and the method of payment, delivery or performance of the Distance Sales Agreement;
e. if the customer has the right of withdrawal, the return form for withdrawal.
7. The customer is aware that Teun's Timber determines the pricing and any guarantees. Teun's Timber is responsible and liable for this.
8. All prices stated on the Teun's Timber website are net, including VAT and excluding delivery and installation.
9. The statutory warranty period applies to all Teun's Timber products. In the event of a warranty claim, the customer must submit the purchase invoice.
10. The customer must contact Teun's Timber directly for any questions and/or complaints regarding the purchased product.
Article 6. Order and delivery
1. The customer can purchase the offered product through the ordering process on the Teun's Timber website.
2. Upon request, the customer will receive an invoice from Teun's Timber.
3. All products remain the property of Teun's Timber until the customer has paid all amounts due in connection with the order to Teun's Timber.
4. Teun's Timber will only deliver a product after payment has been made.
5. When placing an order for a product, the customer undertakes to read and accept these General Terms and Conditions.
6. All transport rates for the Netherlands are valid with the exception of the Wadden Islands. For the Wadden Islands, delivery is made to the logistics point on the mainland. Teun's Timber reserves the right to refuse delivery based on order size and/or geographical location.
7. All wooden products are construction kits unless otherwise stated.
8. Unloading of the products will only take place on the ground floor/next to the (freight) truck unless otherwise agreed with the customer.
9. Teun's Timber is only liable for damage to the articles during transport when it delivers the product to the customer under its own management. Transport by the customer itself or on behalf of the customer by third parties is at your own risk.
10. Any complaints after delivery must be reported to Teun's Timber within 48 hours by e-mail. When signing the packing slip, the customer agrees to the quality of the delivered products. After signing the packing slip, Teun's Timber can unfortunately no longer respond to complaints. If no agreement is reached, the customer can note any complaints on the packing slip, Teun's Timber will then resolve these as soon as possible.
11. All delivery times mentioned are “approximate delivery times”. In accordance with the Distance Selling Act, the customer has the right to terminate the agreement if the delivery time exceeds 30 days.
12. The customer has the right to a cooling-off period based on the law on distance selling; a 14-day inspection period after delivery of the product. Within this period, a product may be returned without giving a reason. After the expiry of this inspection period, the purchase agreement becomes a fact. In order to use the option to return the purchased product, the customer must meet the following conditions:
a. The customer must report the return by e-mail and return the product in question to Teun's Timber within 14 days.
b. The customer must return the product in good condition and in its original packaging, including the return form.
c. The customer must return the product in the condition in which it was received, including the original packaging material. Rebuilt products cannot be returned. If the product is used or damaged, Teun's Timber will charge the customer a fee of at least 15% of the purchase price. This will be deducted from the purchase price to be refunded. If the original packaging of the product is unnecessarily damaged, Teun's Timber will also charge the customer a fee of at least 25% of the purchase price.
d. During the cooling-off period, the customer can only view the product. This means that the Customer can check it with what the customer has seen of the product on the website. The product cannot be assembled, placed or used. We also cannot respond to complaints about assembled articles.
e. Shipping costs for returning the product are the responsibility of the customer.
13. Teun's Timber cannot be held liable if injury occurs due to incorrect use of the purchased goods.
14. Teun's Timber cannot be held liable for colour, grain and/or structural differences in the product.
15. For painted and sprayed products, Teun's Timber cannot provide any guarantee on the paint layer under any circumstances due to the natural working of wood.
16. Teun's Timber cannot be held liable for cracking and the working of wood. Wood is a natural product and especially in periods when the temperature fluctuates strongly, this results in the expansion and shrinkage of wood. The customer then quickly suspects that he has been cheated in some way, but this is only a natural phenomenon. A skilled woodworker will explain that wood is a hygroscopic material that adapts to the climate of the environment, so that the humidity of the wood and the volume (of the wood) also change. Teun's Timber asks for understanding for this beautiful natural material.
17. Teun's Timber will return the payment as soon as possible and directly to the customer if the customer has already paid an amount and he exercises his right of withdrawal within the period of thirty (30) days. However, the customer can only claim a refund if the product has been received by Teun's Timber again. Payment is made using the same payment method as the customer used and no later than the legally prescribed period of 14 days.
Article 7. Information and use of data
1. For optimal service provision by Teun's Timber, it is necessary that the customer keeps a close eye on his e-mail or other communication channels initiated by the customer during the ordering process, so that the customer can take note of information sent by Teun's Timber to the customer in a timely manner.
2. Teun's Timber requests the customer for personal data when registering an account and/or placing an order. The customer agrees that his personal data (such as the name and address details and an e-mail address) will be used to the extent necessary to execute the purchase agreement. The customer agrees that Teun's Timber has the right, without liability towards the customer, to disclose the customer's data to third parties if Teun's Timber is legally obliged to do so or deems it appropriate to fulfill any part of the purchase agreement.
Article 8. Miscellaneous
1. Teun's Timber is entitled to limit, not grant or revoke certain privileges or to block the use of accounts or to deny or limit the possibility to order products via the website, depending on the trading history of a customer; this is solely at the discretion of Teun's Timber.
2. If Teun's Timber has permitted deviations from these General Terms and Conditions for a short or long period of time, either tacitly or otherwise, this shall not affect its right to subsequently demand immediate and strict compliance with these General Terms and Conditions. The customer may never assert any right on the grounds that Teun's Timber applies these General Terms and Conditions flexibly at any time.
3. If any provision of the General Terms and Conditions is found to be wholly or partially void, voidable or unenforceable by the person competent to judge such provision under the applicable law, the General Terms and Conditions shall be deemed rescindable to the extent that the voidness, voidability or unenforceability is concerned and the other provisions of the General Terms and Conditions and the provision shall otherwise remain in force.
4. Teun's Timber is at all times entitled to no longer make available the functionalities for the purpose of the offer on the website without giving any reason.
5. Teun's Timber is entitled to transfer its rights and obligations under these General Terms and Conditions to a third party/parties. Teun's Timber will notify the customer of this in a timely manner.
6. Teun's Timber may amend these General Terms and Conditions and shall announce such amendments in a timely and adequate manner prior to their implementation. Announcement may also be made digitally. Deviations from the provisions of these General Terms and Conditions may only be made in writing, in which case the remaining provisions shall remain in full force.
Article 9. Applicable law
The purchase agreement, these General Terms and Conditions and the rights and obligations arising therefrom between Teun's Timber and the customer are subject to Dutch law and all disputes arising therefrom or related thereto will in the first instance be settled exclusively by the competent authorities.
